Medbox Begins Operations in Oregon, New York, Illinois and Nevada

US Court Records Show Nearly 500 Years in Prison Time for Medical Marijuana Offenses

SAN FRANCISCO, CA — In spite of growing public support for medical marijuana, concern about overreach by the U.S. Department of Justice and other federal agencies, and cutbacks in federal spending, the U.S. government’s war on medical marijuana is raging unabated according to a survey of court records by Cal NORML.

On Tuesday, Michigan medical marijuana grower Jerry Duval, a kidney and pancreas transplant patient with severe medical problems, began serving a ten-year sentence in the same prison as the Boston bomber. Duval joins a growing list of defendants in states that allow medical marijuana who have been charged by the Department of Justice for violating federal laws prohibiting medical marijuana.

Nevada Governor Signs Medical Marijuana Dispensary Bill Into Law

CARSON CITY, NV — Thirteen years after 65 percent of Nevada voters approved the medical use of marijuana, patients will soon have legal access to their medicine as Republican Governor Brian Sandoval signed Senate Bill 374 into law Wednesday evening.

The bill, introduced by Las Vegas Democrat Senator Tick Segerblom, establishes the framework for medical marijuana dispensaries to open state wide, while allowing patients to continue growing their own marijuana until 2016.

The bill was passed in the final days of the legislative session, first in the Senate and then the Assembly, following an emergency declaration by lawmakers to push the bill through in the final weekend.

The law will allow up to 40 medical marijuana dispensaries in the Las Vegas area, 20 in Reno, two in Carson City and one in each of Nevada’s remaining rural counties.

Nevada Assembly Approves Medical Marijuana Dispensaries

CARSON CITY, NV – The Nevada Assembly voted 28-14 Monday to pass a bill establishing marijuana dispensaries.

The bill was passed last week by the Senate by a 17-4 vote and needed swift action by the Assembly as the legislature adjourns for the 2013 session at midnight.

An amendment to the bill by the Assembly needs final approval from the Senate before the bill is sent to the desk of Republican Gov. Brian Sandoval, who has said he will consider the proposal.

Under  Senate Bill 374, which was unanimously approved by the Senate Judiciary Committee in April, and received a favorable “do pass” recommendation from the  Senate Finance Committee on Tuesday, the state Board of Pharmacy would be charged with regulating and overseeing medical marijuana dispensaries across the state.

The bill would allow up to 40 medical marijuana dispensaries in the Las Vegas area, 20 in Reno, two in Carson City and one in each of Nevada’s remaining rural counties.

Nevada Senate Passes Medical Marijuana Dispensary Bill

CARSON CITY, NV – Hoping to clear up some of the legal ambiguity surrounding Nevada’s medical marijuana law, a bill that would expand the state’s existing medical marijuana program to allow for the licensing of non-profit medical marijuana dispensaries was approved by the full Senate by a 17-4 vote Wednesday.

The bill, which now advances to the Assembly for consideration, would need swift committee action and a vote by the full Assembly to become law.  The Legislature adjourns for the year at midnight Monday.

Under  Senate Bill 374, which was unanimously approved by the Senate Judiciary Committee in April, and received a favorable “do pass” recommendation from the  Senate Finance Committee on Tuesday, the state Board of Pharmacy would be charged with regulating and overseeing medical marijuana dispensaries across the state.

Nevada Medical Marijuana Dispensary Clears Final Committee, Advances to Vote by Full Senate

CARSON CITY, NV – Hoping to clear up some of the legal ambiguity surrounding Nevada’s medical marijuana law, a bill that would expand the state’s existing medical marijuana program to allow for the licensing of non-profit medical marijuana dispensaries has passed a final committee hearing and has advanced to a third reading and vote by the full Senate.

The bill, Senate Bill 374, was unanimously approved by the Senate Judiciary Committee in April, and received a favorable “do pass” recommendation from the  Senate Finance Committee on Tuesday.

The Finance Committee added a key amendment to the bill that will allow the Department of Health and Human Services to receive temporary funding from the State General Fund to pay for the initial costs of implementing the dispensary program until revenue from registration fees are collected and the program becomes self sufficient.

Nevada Considers Removing Marijuana DUI Provision from Medical Marijuana Law

CARSON CITY, NV — Some Nevada lawmakers say medical marijuana patients shouldn’t be deemed impaired when driving just because they have small amounts of marijuana in their system.

The idea sparked intense debate Tuesday when Assembly Majority Leader William Horne, D-Las Vegas, presented Assembly Bill 351 to the Senate Health and Human Services Committee.

“Marijuana is currently the only drug we have a limit where we say, ‘you have this much, so you must be impaired,’” Horne told committee members. “I think that’s unfair.”

Under current law, drivers with a certain trace of marijuana in their blood are deemed impaired and are guilty of driving under the influence. The same concept applies to the blood alcohol content in drunken drivers.

This bill would remove the binding power of residual marijuana content for medical marijuana cardholders. Prosecutors could still use the blood test to augment their case, but further proof would have to be provided to show the driver was actually impaired.

“I don’t have a problem with the per se limits being there for everybody else,” Horne said. “What I am saying is, for a patient, those per say limits should not apply because we don’t apply them to any other drug.”

Judge Denies Motion To Dismiss Marijuana Case

A judge Tuesday Sep 27 2009 denied the motion that would dismiss a criminal case against defendants in Nevada who say they were only distributing state-sanctioned medical marijuana. Nevada District Judge Smith ruled the state law "is written with sufficient definiteness so as not to be void for vagueness." District Judge acknowledged the Legislature of the USA might not have appropriately addressed "methods of supply of medicinal marijuana to patients authorized to use it." Nevada law  will allows medical marijuana cardholders to possess, deliver or produce certain amounts of marijuana for pain relief. However, other state and federal laws make it illegal to buy or sell marijuana. More than a dozen defendants facing criminal charges for distributing medical marijuana have argued the Nevada law is self-contradictory. It is becoming clear that with medicinal marijuana becoming legal we are faced with older laws that will contradict what is now legal.
