Oregon Attorney General Endorses Medical Marijuana Dispensary Bill

SALEM, OR — A bill that would expand Oregon’s medical marijuana program to authorize and regulate medical marijuana dispensaries has been endorsed by Attorney General Ellen Rosenblum, who has sent letters to state lawmakers in support of the bill.

House Bill 3460, which is scheduled for a hearing at 4:30 today by the House Ways and Means Committee, would direct the Oregon Health Authority to establish a registration system for medical marijuana dispensaries, which exist in the state but are unregulated and are subject to state and local prosecution.

“Over the past several years approximately 150 medical marijuana facilities have opened and continue to operate in Oregon without regulation on licensure,” Attorney General Rosenblum wrote in a letter of endorsement to the bill’s primary sponsors in the legislature.

“These facilities operate in a climate of uncertain legality, and the absence of a clear regulatory structure makes ensuring compliance with the law difficult. HB 3460 tackles this problem by putting in place a regulatory framework for marijuana facilities, giving the Oregon Health Authority oversight and control over their lawful operation, and thereby ensuring that all persons with a valid Oregon Medical mar. . . . . Nevada Governor Signs Medical Marijuana Dispensary Bill Into Law

CARSON CITY, NV — Thirteen years after 65 percent of Nevada voters approved the medical use of marijuana, patients will soon have legal access to their medicine as Republican Governor Brian Sandoval signed Senate Bill 374 into law Wednesday evening.

The bill, introduced by Las Vegas Democrat Senator Tick Segerblom, establishes the framework for medical marijuana dispensaries to open state wide, while allowing patients to continue growing their own marijuana until 2016.

The bill was passed in the final days of the legislative session, first in the Senate and then the Assembly, following an emergency declaration by lawmakers to push the bill through in the final weekend.

The law will allow up to 40 medical marijuana dispensaries in the Las Vegas area, 20 in Reno, two in Carson City and one in each of Nevada’s remaining rural counties.

Feds Launch New Crackdown on California Medical Marijuana Dispensaries

LOS ANGELES, CA — Federal prosecutors have sent dozens of letters warning medical marijuana shops in Los Angeles and Long Beach to shut down or risk potential criminal or civil action in the latest attack in the War on Marijuana.

Authorities say more than 100 medical marijuana dispensaries across Los Angeles County received the letters Tuesday.

Lawsuits also were filed against two property owners in Long Beach, telling them it’s illegal to allow pot sales in buildings they own.

California’s federal prosecutors launched a coordinated crackdown on the state’s medical marijuana industry in 2011 by threatening landlords with property forfeiture. Since then, many of the 625 dispensaries targeted in the seven-county Central District of California have closed.

California was the first state to legalize marijuana for medical use when voters passed Proposition 215 in 1996, but marijuana remains illegal under federal law.

Nevada Assembly Approves Medical Marijuana Dispensaries

CARSON CITY, NV – The Nevada Assembly voted 28-14 Monday to pass a bill establishing marijuana dispensaries.

The bill was passed last week by the Senate by a 17-4 vote and needed swift action by the Assembly as the legislature adjourns for the 2013 session at midnight.

An amendment to the bill by the Assembly needs final approval from the Senate before the bill is sent to the desk of Republican Gov. Brian Sandoval, who has said he will consider the proposal.

Under  Senate Bill 374, which was unanimously approved by the Senate Judiciary Committee in April, and received a favorable “do pass” recommendation from the  Senate Finance Committee on Tuesday, the state Board of Pharmacy would be charged with regulating and overseeing medical marijuana dispensaries across the state.

The bill would allow up to 40 medical marijuana dispensaries in the Las Vegas area, 20 in Reno, two in Carson City and one in each of Nevada’s remaining rural counties.

Nevada Senate Passes Medical Marijuana Dispensary Bill

CARSON CITY, NV – Hoping to clear up some of the legal ambiguity surrounding Nevada’s medical marijuana law, a bill that would expand the state’s existing medical marijuana program to allow for the licensing of non-profit medical marijuana dispensaries was approved by the full Senate by a 17-4 vote Wednesday.

The bill, which now advances to the Assembly for consideration, would need swift committee action and a vote by the full Assembly to become law.  The Legislature adjourns for the year at midnight Monday.

Nevada Medical Marijuana Dispensary Clears Final Committee, Advances to Vote by Full Senate

CARSON CITY, NV – Hoping to clear up some of the legal ambiguity surrounding Nevada’s medical marijuana law, a bill that would expand the state’s existing medical marijuana program to allow for the licensing of non-profit medical marijuana dispensaries has passed a final committee hearing and has advanced to a third reading and vote by the full Senate.

The bill, Senate Bill 374, was unanimously approved by the Senate Judiciary Committee in April, and received a favorable “do pass” recommendation from the  Senate Finance Committee on Tuesday.

The Finance Committee added a key amendment to the bill that will allow the Department of Health and Human Services to receive temporary funding from the State General Fund to pay for the initial costs of implementing the dispensary program until revenue from registration fees are collected and the program becomes self sufficient.

Los Angeles Citizens Vote to Regulate Medical Marijuana

LOS ANGELES, CA – The citizens of Los Angeles voted to regulate medical marijuana by voting to pass Proposition D Tuesday, one of three medical marijuana regulation measures on the ballot.

Proposition D, which received 62.57% of the vote, caps the number of collectives at those who opened prior to 2007, about 130, raises the gross receipts tax from $50 to $60 per $1000 of gross receipts, and establishes the distances they must keep from schools, parks, one another and residential neighborhoods.

It also requires that collectives be closed between 8 p.m. and 10 a.m., prohibits the consumption of marijuana on the premises and requires background checks on managers.

The Proposition also does not allow for a new collective to receive a permit if one of the pre-2007 collectives closes.

Proposition D was also supported by several members of the City Council, the Greater Los Angeles Collective Association (GLACA), the United Food and Commercial Workers Union (UFCW), both Los Angeles mayoral candidates and the current city attorney and his challenger.

Los Angeles Medical Marijuana Dispensary Vote Tuesday

LOS ANGELES, CA — Los Angeles politicians have struggled for more than five years to regulate medical marijuana, trying to balance the needs of the sick against some neighborhood concerns that medical marijuana dispensaries may attract crime.

Voters will head to the polls Tuesday to decide how Los Angeles should regulate medical marijuana dispensaries with three separate measures that seek to either limit the number of dispensaries or allow new ones to open and join an estimated several hundred others that currently operate.

Election Day in the nation’s second-largest city comes just two weeks after a pivotal state Supreme Court decision gave cities and counties the authority to ban dispensaries.
