Oklahoma Becomes Third State This Year To Approve Unscientific Per Se Limits For Cannabis

OKLAHOMA CITY, OK — Oklahoma Gov. Mary Fallin has signed legislation, House Bill 1441, into law that criminalizes drivers from operating a motor vehicle if they have any detectable amount of THC and/or its inactive metabolites in their blood, saliva, or urine.

Under such internal possession statutes, known as zero tolerance per se laws, a motorist who tests positive for the presence of such compounds is guilty per se (in fact) of a criminal traffic safety violation, regardless of whether or not there exist supporting evidence that the defendant was behaviorally impaired by such compounds.

Residual, low levels of THC may remain present in the blood of occasional consumers for several hours after past use and for several days in habitual consumers — long after any behavior-inducing effects of the substance have worn off. The inert carboxy-THC metabolite, a commonly screened for byproduct of THC, possesses a longer half-life in blood and also may be present in the urine of daily cannabis consumers for several weeks, or even months, after past use.

Michigan Supreme Court Rules in Favor of Medical Marijuana Patient in DUI Case

LANSING, MI — A Michigan traffic safety law that prohibits the operation of a motor vehicle by persons who possess any presence of THC in their blood, regardless of whether or not they are behaviorally impaired by the substance, may not be strictly applied to state-qualified medical cannabis patients. So decided the Michigan Supreme Court on Tuesday in the case People v Koon.

In a unanimous opinion, the Court determined that legal protections extended to state-qualified patients under the Michigan Medical Marihuana Act, enacted by voters in 2008, supersede the state’s zero tolerance, internal possession law. As a result, the Court determined that state prosecutors must establish that authorized patients charged under the statute are actually impaired by their cannabis use in order to gain a DUI criminal conviction.

Stoned Driving Limits: You Asked to “Treat it like Alcohol”

With Washington State’s I-502 legalization came a 5ng/ml limit of active THC in blood.  This is now per se evidence to convict on a DUI charge.

In Colorado, the governor is poised to sign a bill creating a 5ng/ml limit that has failed to pass in six previous attempts.  This would set a permissible inference of guilt on a DUI charge.

To my fellow supporters of marijuana legalization, I’m reminded of the saying, “Be careful what you wish for because you might get it.”

Before I explain that, let’s make sure everyone reading is familiar with the concepts:

  • These limits in Colorado and Washington refer to active THC in the blood, not the inactive metabolites you get busted for on a workplace pee test, sometimes days or weeks after cannabis use.
  • per se limit means you’re automatically guilty and have no defense.  You could be driving absolutely perfectly and still be guilty of a DUI if your blood is >5ng/ml.
  • permissible inference means that you’re presumed to be guilty, but you can defend yourself if you can prove you weren’t driving impaired, even if your blood is >5ng/ml.

Nevada Considers Removing Marijuana DUI Provision from Medical Marijuana Law

CARSON CITY, NV — Some Nevada lawmakers say medical marijuana patients shouldn’t be deemed impaired when driving just because they have small amounts of marijuana in their system.

The idea sparked intense debate Tuesday when Assembly Majority Leader William Horne, D-Las Vegas, presented Assembly Bill 351 to the Senate Health and Human Services Committee.

“Marijuana is currently the only drug we have a limit where we say, ‘you have this much, so you must be impaired,’” Horne told committee members. “I think that’s unfair.”

Under current law, drivers with a certain trace of marijuana in their blood are deemed impaired and are guilty of driving under the influence. The same concept applies to the blood alcohol content in drunken drivers.

This bill would remove the binding power of residual marijuana content for medical marijuana cardholders. Prosecutors could still use the blood test to augment their case, but further proof would have to be provided to show the driver was actually impaired.

“I don’t have a problem with the per se limits being there for everybody else,” Horne said. “What I am saying is, for a patient, those per say limits should not apply because we don’t apply them to any other drug.”

Colorado Legislature Sets 5 Nanogram Marijuana Limit for Motorists

DENVER, CO — Lawmakers took a step toward implementing Colorado’s recreational marijuana law on Tuesday when they set blood-level limits for driving, but a measure to tax retail pot was in limbo a day before the legislative session was set to end.

Along with Washington state, Colorado voters in November approved the use of small amounts of marijuana by adults. The Colorado vote directed state lawmakers to set up a regulatory framework for the sale and taxation of cannabis.

The driving-while-stoned bill sets a 5-nanogram-per-milliliter threshold for tetrahydrocannabinol, the active ingredient in marijuana. The proposal now heads to Governor John Hickenlooper, who has indicated his support for the measure.

“I think this is an important part” of regulating pot, Hickenlooper, a Democrat, told reporters on Monday.

Washington had the 5-nanogram limit set in its ballot language that voters approved in November.

Colorado legislature had failed in its previous attempts to impose a marijuana limit for driving under the state’s medical pot law, which has been in effect since 2001.
